TERMS AND CONDITIONS WHEN BUYING A PHOTO PRODUCT
1. Definitions:
1.2 WeLeaf: Zoë Agasi and Olivier van Herck are the copyright holders of the product.
1.3 (photo) -Product: a digital photo file in .jpeg format that is offered for sale by WeLeaf to Customers.
1.4 Customer: the (potential) buyer of a (photo) product.
2. General:
2.1 When purchasing (photo) products, you automatically (tacitly) agree to these conditions. If you object to these conditions, you can only make this known in writing and prior to the purchase.
2.2 These general terms and conditions apply to all (photo) products, offers, quotations, agreements and other legal relationships between WeLeaf and the Customer.
2.3 Deviation from these general terms and conditions is only possible after the parties have agreed this in writing.
2.4 WeLeaf can modify these terms and conditions at any time.
2.5 These terms and conditions also apply to any third parties to whom the customer donates his product. Read 3.3 for donations.
3. Copyright and publications:
3.1 All (photo) products are subject to copyrights by WeLeaf. WeLeaf owns all rights in and to the product and retains all rights to the product, which are not transferred herein, and retains all common law copyrights. You are purchasing a digital photo, not the rights of the photo.
3.2 All WeLeaf digital (photo)-products are copyrighted and for your own use only. It is therefore not permitted to propagate, publish or edit these products for giving or selling without the prior written permission of WeLeaf. With the exception of point 3.3: Donations.
3.3 Donation: You can give the (photo) product as a gift, but you are no longer in possession of this product and you transfer the product and the general terms and conditions to the receiver. Think of the digital product as a physical product that cannot be duplicated. You own it or give it as a present.
3.4 If you want to use the product commercially, publish or edit it, you must always request prior written permission from WeLeaf. Any permission for publication is valid only through a written agreement with WeLeaf (through a License), which you must be able to show at any request from WeLeaf.
3.5 WeLeaf may use the photos at any time in its sole discretion, sell them to third parties, reproduce and publish them for both non-commercial and commercial purposes. WeLeaf is not obliged to report this to customers of the same (photo)-product.

ALGEMENE VOORWAARDEN BIJ KOOP VAN EEN FOTO PRODUCT
1. Definities:
1.1 WeLeaf: Zoë Agasi en Olivier van Herck zijn de auteursrechthebbende van het product.
1.2 (foto)-Product: een digitaal fotobestand in .jpeg formaat dat door WeLeaf aan Klanten te koop aangeboden wordt.
1.3 Klant: de (potentiële) koper van een (foto)-product.
2. Algemeen:
2.1 Bij het afnemen van (foto)-producten gaat u automatisch (stilzwijgend) akkoord met deze voorwaarden. Heeft u tegen deze voorwaarden bezwaar, dan kunt u dat enkel schriftelijk en voorafgaand aan de koop kenbaar maken.
2.2 Deze algemene voorwaarden zijn van toepassing op alle (foto)-producten, aanbiedingen, offertes, overeenkomsten en andere rechtsbetrekkingen tussen WeLeaf en de Klant.
2.3 Afwijken van deze algemene voorwaarden kan enkel nadat partijen dit schriftelijk zijn overeengekomen.
2.4 Deze algemene voorwaarden kunnen op ieder gewenst moment door WeLeaf worden aangepast.
2.5 Deze algemene voorwaarden gelden ook voor eventuele derden aan wie de klant zijn product schenkt. Lees 3.3 voor schenkingen
3. Auteursrecht en publicaties:
3.1 Op geleverde (foto)-producten rusten altijd de auteursrechten WeLeaf. U koopt een digitale foto, niet de rechten op de foto.
3.2 Alle digitale (foto)-producten van WeLeaf zijn auteurs rechtelijk beschermd en uitsluitend voor uw eigen gebruik. Het is daarom niet toegestaan deze producten te vermeerderen, te publiceren of te bewerken om weg te geven of verkopen zonder voorafgaande schriftelijke toestemming van WeLeaf. Met uitzondering van punt 3.3: Schenkingen.
3.3 Schenkingen: U kunt het (foto)-product cadeau doen, maar u bent dan zelf niet meer in bezit van dit product en u draagt daarbij het product en de algemene voorwaarden aan de schenker over. Zie het digitale product als een fysiek product dat niet te dupliceren valt. U bezit het zelf of doet het cadeau.
3.4 Indien u een foto wil gebruiken commercieel wil gebruiken of publiceren, moet u hiervoor altijd voorafgaande schriftelijke toestemming vragen aan WeLeaf . Iedere toestemming voor publicatie is slechts rechtsgeldig via een schriftelijke overeenkomst met WeLeaf (via een Licentie), deze moet u op ieder verzoek van WeLeaf kunnen tonen.
3.5 WeLeaf mag de foto’s, te allen tijde naar eigen inzicht gebruiken, verkopen aan derden, verveelvoudigen en publiceren voor zowel non-commerciële als commerciële doeleinden. WeLeaf is niet verplicht dit te melden aan klanten met hetzelfde werk.
